djvishwajeet.in (“we”, “us”, or “our”) respects the intellectual property rights of others and expects users of our Site to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, we will respond expeditiously to clear notices of alleged copyright infringement that comply with the requirements set forth below.
1. Notice of Claimed Infringement
If you are a copyright owner or an agent thereof and you believe that any content on djvishwajeet.in infringes your copyrights, you may submit a written notification (“DMCA Notice”) to our designated agent. To be effective under 17 U.S.C. § 512(c)(3), your DMCA Notice must include substantially the following:
- A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notice, a representative list of those works).
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate the material — for example, the URL of the page on djvishwajeet.in.
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and email address.
- A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. How to Submit a DMCA Notice
Send your complete DMCA Notice to our designated agent by email with the subject line [DMCA Notice]:
Email: support@djvishwajeet.in
Incomplete notices may delay our response or be deemed ineffective. We will not act on notices that do not substantially comply with the requirements of 17 U.S.C. § 512(c)(3).
3. Our Response
Upon receipt of a valid DMCA Notice, we will (a) remove or disable access to the allegedly infringing material; (b) make a reasonable effort to notify the user who posted the material, if applicable; and (c) take additional steps as we deem appropriate, including termination of repeat infringers under Section 5 below.
4. Counter-Notification
If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a written counter-notification (“Counter-Notice”) under 17 U.S.C. § 512(g)(3). Your Counter-Notice must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of that person.
Send your Counter-Notice to support@djvishwajeet.in with the subject line [DMCA Counter-Notice]. If we receive a valid Counter-Notice, we may forward a copy to the original complaining party, and we may restore the removed material in not less than 10 nor more than 14 business days following receipt of the Counter-Notice, unless we first receive notice that the complaining party has filed a court action seeking a restraining order.
5. Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
6. Misrepresentation
Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by a service provider. Please consider this carefully before filing a Notice or Counter-Notice.
